A defamation lawsuit from former Nickelodeon producer Dan Schneider against Warner Bros. Discovery over his portrayal in Quiet on Set: The Dark Side of Kids TV has been dismissed.
California’s Second District Court of Appeal on Thursday reversed a decision allowing Schneider to proceed with his lawsuit, rejecting arguments that the docuseries implied that the producer sexually abused children who worked on the Nickelodeon series he created and ran.
“The documentary clearly distinguishes between the lamentable conduct that its participants attribute to Schneider — gender discrimination, harassment, toxic workplace behavior, and inappropriate sexual innuendo — and the child sexual abuse explicitly attributed to three named individuals,” stated the decision.
The docuseries debuted in 2024 to massive ratings, chronicling Schneider’s rise as a prolific producer of children’s television series. In the third episode, Drake Bell, the star ofDrake & JoshandThe Amanda Show, came forward as the then-anonymous victim in a sexual assault case against Brian Peck, who was convicted in 2004 of sexually assaulting the actor. In a video after the project’s release, Schneider said he didn’t hire the dialogue coach. He later stated that he had knowledge of the abuse.
The ruling marks a major win for Warner Bros., which didn’t respond to requests for comment, after a California state court in 2024 rejected a bid to dismiss the case. Los Angeles Superior Court Judge Ashfaq G. Chowdhury had found that viewers could draw “damning implications” about Schneider’s conduct toward children.
The question at the center of the appeal: whether the documentary can be understood to suggest that Schneider sexually abused children.
In Thursday’s ruling, the court found that filmmakers explicitly told viewers that Schneider wasn’t implicated in the abuse. It pointed to the docuseries exploring an internal Nickelodeon investigation that didn’t find any evidence of inappropriate sexual behavior by Schneider toward children.
“Schneider’s attempt to find an alternative meaning than what is expressly stated in the documentary is unavailing,” the order stated.
A significant thrust of the lawsuit was the title dancing around claims Schneider sexually abused children. One example: Quiet on Set introduces viewers to the sexual abusers, Peck and Jason Handy, in the second episode while repeatedly cutting to images of Schneider while discussing the duo. The producer had targeted the allegedly manipulative editing.
Responding to arguments over the juxtaposition of the images, the three-judge panel of the state appeals court rebuffed Schneider’s characterization of the sequence. A review of the segment shows that roughly six minutes of the episode are focused on Handy, it said, with no time dedicated to Schneider during the scenes.
The court said it will “refrain from splitting hairs to find an allegation of child sexual abuse where the only such abuse discussed is explicitly attributed to named perpetrators and the documentary expressly states that an investigation into Schneider found no evidence of abuse.”
In a statement, Gerry Silver, a lawyer for Schneider, said the producer is evaluating “options for further review and appeal.” He added, “We are pleased that the Court acknowledged that the makers of Quiet on Set presented absolutely no evidence that Dan was sexually abusive towards any of his cast members and agreed that any such allegation is provably false.”
Warners’ appeal was handled by Theodore J. Boutrous, Ilissa Samplin, Zachary C. Freund, and Connor S. Sullivan of Gibson Dunn. The Reporters Committee for Freedom of the Press and the International Documentary Association filed friend-of-the-court briefs supporting the studio in the case.
Warner Bros. Discovery, which distributed the project on Max alongside Investigation Discovery, and producers Maxine Productions and Sony Pictures Television were named in the complaint. Schneider had sought unspecified damages and a court order forcing producers to remove allegedly defamatory portions of the docuseries or have it completely taken down.
