US Explains Why Foreigners Cannot Get Their Money Back After a Visa Denial

The US Department of State has stated that foreigners denied a US visa will not receive a refund of their application fee, which it refers to as a non-refundable processing charge.

According to information from the US Department of State, the visa application fee covers the cost of processing the application, regardless of whether it is approved or denied.

“Can I get my money back?” The official answer is simply: “No. “You paid a non-refundable application processing fee.”

US law requires visa applicantsvisa applicants to be interviewed in person by a consular officer at a US Embassy or Consulate.

After reviewing all necessary material, the officer evaluates whether the applicant is eligible for the visa category asked for.

Several reasons can lead to a denial. An application may be rejected

  • if the consular officer lacks sufficient information to make a decision
  • if the applicant does not meet the requirements for the visa category in question,
  • if the applicant is inadmissible or ineligible under US immigration law.

An applicant’s past or current conduct, such as drug offenses or criminal activity, may potentially disqualify him or her.

Among the most frequently cited legal grounds for denial are incomplete applications or missing supporting documents under INA Section 221(g), failure to demonstrate non-immigrant intent under INA Section 214(b), likelihood of becoming a public charge under INA Section 212(a)(4), fraud or misrepresentation under INA Section 212(a)(6)(C)(i), and prior illegal presence in the United States under INA Section 212(a)(9)(B)(i).

What Happens After a Visa Denial

When an application is denied, the consular official usually informs the applicant of the precise section of law under which the refusal occurred.

Applicants may also be informed whether they are eligible to seek a waiver of their ineligibility. Denied applicants may reapply, but no guarantee of approval is provided.

A friend or relative cannot inquire on behalf of a denied applicant because visa records are protected under US privacy legislation.

The Department of State’s policy on non-refundable fees is based on the administrative costs associated with processing each application, regardless of its outcome.
